Tipaklong Sustainable Mobility Corporation (hereinafter referred to as “Tipaklong,” “Company,” “We,” or “Us”) values and protects your data privacy rights under the Data Privacy Act of 2012 (“DPA”), its Implementing Rules and Regulations, and related issuances of the National Privacy Commission (“NPC”).

This Privacy Policy (the “Policy”) informs You on how we collect, process, use and protect Your personal information. By ticking the “I Agree” checkbox prior to the creation of Your Account or submission of Your Registration Data, You agree to the collection and use of information in accordance with this Policy. Tipaklong, through the Platform, provides mobility sharing services which allow Users to rent electric bicycles, electric scooters, electric mopeds, electric tricycles and other sustainable mobility devices (the “Services”).

“Personal Data” refers to personal information, sensitive personal information and privileged information which we collect from you, such as your name, address, age, email address, and mobile/phone number.

Location Data. We may also collect and store information about your location when using the Services (“Location Data”) when you give us permission to do so. You can modify or limit the Platform’s access to your Location Data through the Platform settings.

Usage Data. We will also be collecting certain information when you visit, use or navigate the Platform, which may include your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites and other technical information.

Tracking & Cookies Data. We use cookies and similar tracking technologies to track the activity on Our Platform and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to Your browser from a website and stored on Your device. We will respect your request in so far as it is feasible to fulfill the purposes for which the personal data was collected, and to the extent allowed by law and regulations.

Tipaklong may share and/or disclose your Personal Data for the purposes indicated above with (a) the government and its agencies; (b) Tipaklong’s affiliates and subsidiaries; and/or (c) Third party service providers and partners, which may include banks and other financial institutions, and their officers, employees, personnel, and other authorized representatives.

Disclosures to the above third parties may be done for the following purposes: (a) To provide the Services; (b) To store data; and (c) Fulfill any other purposes directly related to the above-stated purposes.

Your information, including Personal Data, may be transferred to and maintained on computers located outside of Your city, province, country or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.

Tipaklong will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

When the processing of your personal data is outsourced by the Company to a third party, the processing will be subject to written agreements between the Company and the third parties processing the data. These written agreements specify the rights and obligations of each party and will provide that the third party has adequate security measures in place and will only process your personal information on the specific written instructions of the Company.

The Company may also transfer your personal information to third parties as required by law or legal instrument, to protect the Company’s rights or assets, to facilitate acquisition or disposition of the Company’s businesses, and in emergencies where the health or safety of a person is endangered.

The Company will not sell, rent, share, trade, or disclose any of your personal data to any other party without your prior written consent, with the exception of entities within the Company and any third-party service providers which the Company has engaged, whose services necessarily require the processing of your personal data.

a. The right to access personal information

Under the DPA, individuals can request access to any of their personal data held by the Company, subject to certain restrictions. A request for disclosure of such information is called a subject access request. Any such requests should be addressed to the Company’s Data Protection Officer.

b.The right to make corrections to personal information

The DPA requires the Company to take reasonable steps to ensure that any personal data it processes is accurate and up-to-date. It is your responsibility to inform us of any changes to the personal information that you have supplied to us during the course of your use of and access to the Platform and Services.

c.The right to object to the processing of personal information

You have the right to object to the processing of your personal information, including processing for direct marketing, automated processing or profiling. You shall also be notified and be given an opportunity to withhold consent to the processing in case of changes or any amendment to the information supplied or declared to you in this Data Privacy Notice. Please note that some of the personal data you have provided to us is necessary for us to comply with statutory and regulatory requirements, as well as the Company’s administrative policies and is thus mandatorily required to be collected and processed. Withholding of your consent to the processing of certain personal data may prevent you from availing of certain benefits.

d.The right to erasure or blocking of personal information

You have the right to suspend, withdraw or order the blocking, removal or destruction of your personal information from our filing system.

e.The right to be informed of the existence of processing of personal information

You have the right to be informed whether personal information pertaining to you shall be, is being, or have been processed, including the existence of automated decision-making and profiling.

f.The right to damages

Upon presentation of a valid decision, the Company recognizes your right to be indemnified for actual and verifiable damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal information, taking into account any violation of your rights and freedoms as a data subject.

g.The right to lodge a complaint

You are also granted the right to lodge a complaint before the NPC.

The Company has implemented organizational, physical and technical security measures, policies, and procedures intended to reduce the risks of accidental destruction or loss, or the unauthorized disclosure or access to Personal Data which we collect and store on our systems. We may retain Personal Data only for as long as necessary to fulfill or complete the foregoing and other legitimate purposes. The Company will retain and use your personal information as necessary to comply with its legal obligations, resolve disputes, and enforce its agreements.

The Platform may contain links to other sites that are not operated by Tipaklong. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third party sites or platforms.

Tipaklong Sustainable Mobility Corporation is the Personal Information Controller under the DPA, which means that it determines what purposes personal information it holds will be used for. It may also be that your personal data is disclosed to third parties pursuant to a data sharing agreement. In which case, such third parties are also the personal information controllers of your personal information.
